House Armed Services Minority Says Pentagon Impact Report Required Before the Germany Drawdown

House Armed Services Committee ranking member Adam Smith (D-Wash.) sent Defense Secretary Pete Hegseth a five-page letter Friday afternoon arguing that Friday's announced 5,000-troop withdrawal from Germany cannot lawfully proceed without a written Pentagon impact report under Section 1233 of the National Defense Authorization Act. The letter, signed by all 28 HASC minority members, names the procedural defect: §1233 requires the Secretary to certify in writing, no later than 90 days before any permanent reduction in U.S. forces in Europe below 76,000, that the reduction will not weaken NATO deterrence and will not violate force-posture commitments under the Atlantic Council framework. The paper's Friday account of the Trump Germany threat hardening into the NDAA's 76,000-troop floor framed the move as a Pentagon planning exercise that, below 76,000, has to clear Congress. The Smith letter is what clearing Congress looks like: a procedural-compliance demand, not a policy objection. The minority is not arguing the withdrawal is wrong; it is arguing the §1233 certification is missing.

Hegseth has not responded. The Senate Armed Services minority's parallel letter, expected from ranking member Jack Reed (D-R.I.), was not filed Saturday. The 5,000-troop figure brings U.S. force levels in Europe to approximately 73,500 — 2,500 below the §1233 floor.
