Fisheries and Oceans Canada confirmed this week that the gear analysis for North Atlantic right whale Eg #5217, "Division," matched the harvester's licence and Snow Crab Fishing Area 12 markings to a vintage of 2020 — the first time a right whale entanglement death has been pinned to a specific Canadian fishery, vintage, and CFA via the gear-marking system Canada introduced that year. DFO's 2026-2028 protections, published in March and effective for this season, renew the voluntary shallow-water whalesafe gear pilot for three years rather than transitioning it to a mandatory rule. [2] The pilot lets harvesters fish with rope at lower breaking strengths and modified buoy lines in waters under 20 fathoms in CFAs 12, 19, and 23A. NOAA Fisheries' parallel framework keeps the U.S. ropeless-gear research-and-development program funded but does not impose a bilateral rule on the Gulf of St. Lawrence. [3] Roughly 360 right whales remain in the population, the New England Aquarium estimates; the calving season closed with 23 calves observed, and a Feb 5 dead 3-year-old female (Porcia's 2023 calf) plus a Jan 17 Cape Cod entanglement (Monarch's 2025 calf) keep the census on edge.

The matching depended on the rope marks themselves and on the small buoy that carried the harvester's vessel registration. The harvester had not filed a lost-gear report; under existing rules, no penalty incentive forces one. The pilot renewal does not change that gap. The traceability system worked. The reporting system did not.

What conservation policy now needs is the bilateral rulemaking the gear analysis just made possible. Canada chose a three-year pilot. The 2027 calving season will be the test of whether that is enough.
